1. Acceptance of Terms

We are not liable for losses resulting from technical malfunctions, connection issues, or other circumstances beyond our reasonable control. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Content solely for personal, non-commercial entertainment purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content from the Platform except as expressly permitted by these Terms.

The 55mwb name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of 55mwb or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY PHILIPPINE LAW, 55MWB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS (COLLECTIVELY, THE "55MWB PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content
• Technical malfunctions, errors, or interruptions of service
• Any bugs, viruses, trojan horses, or similar issues transmitted by third parties

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE 55MWB PARTIES EXCEED THE AMOUNT YOU HAVE DEPOSITED INTO YOUR ACCOUNT DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

9. Dispute Resolution and Governing Law

These Terms and your use of the 55mwb Platform shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

9.1 Internal Complaints Procedure

If you have any complaint or dispute regarding the Platform or our services, you must first contact our customer support team through the designated channels provided on the Platform. We will make reasonable efforts to resolve complaints within fourteen (14) business days of receipt. All complaints must be submitted in writing with detailed information regarding the nature of the dispute and any relevant documentation.

9.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, which cannot be resolved through our internal complaints procedure, shall be settled by arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, in the English language. The decision of the arbitrator shall be final and binding upon both parties.

9.3 Class Action Waiver

You agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against 55mwb.

10. General Provisions

10.1 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

10.2 Waiver

No waiver by 55mwb of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by 55mwb to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

10.3 Assignment

You may not assign or transfer these Terms or your account to any third party without 55mwb's prior written consent. 55mwb may assign or transfer these Terms or any rights hereunder without restriction and without notice to you.

10.4 Entire Agreement

These Terms, together with our Privacy Policy, Responsible Gaming Policy, and any game-specific rules, constitute the entire agreement between you and 55mwb regarding your use of the Platform and supersede all prior agreements and understandings, whether written or oral.

10.5 Language

These Terms are provided in English. In the event these Terms are translated into other languages and there is any conflict between the English version and any translation, the English version shall prevail.
